While the caveat is in place over a property, the owner of that property cannot transfer, sell or grant a mortgage over the property.
Irwin Legal can provide advice on lodging or removing caveats over properties (including whether you have the ability to lodge a caveat over a property – also known as a caveatable interest).
There are several ways to remove an existing caveat. Irwin Legal can present you with all your options as well as the most efficient and effective option for you to exercise. If you have previously lodged a caveat and have now received a 21 day notice from Landgate, your caveat will automatically lapse unless an urgent application is made to the Supreme Court to extend the caveat. So, don’t delay, act now!
